END USER LICENSE AGREEMENT (EULA)

Developer: Leafy Wave Interactive

1. LICENSE GRANT

By purchasing, downloading, installing, or using "Balloon Odyssey," you are granted a limited, non-transferable, non-exclusive license to use the game for personal, non-commercial purposes on your personal mobile device, subject to the terms of this Agreement.

2. INTELLECTUAL PROPERTY

All content within the game, including but not limited to graphics, sound, code, and gameplay mechanics, is the intellectual property of Leafy Wave Interactive. You are not allowed to copy, modify, distribute, reverse engineer, or create derivative works based on any part of the game.

3. PROHIBITED USES

You agree not to:

• Distribute or resell the game or any of its content.
• Attempt to hack, cheat, modify, or reverse engineer the game.
• Use the game in any way that violates laws or infringes third-party rights.

4. NO WARRANTY

This game is provided “as is.” Leafy Wave Interactive makes no warranties, expressed or implied, and hereby disclaims all warranties including but not limited to fitness for a particular purpose and non-infringement. We do not guarantee that the game will run error-free or without interruption on all devices.

5. LIMITATION OF LIABILITY

In no event shall Leafy Wave Interactive be held liable for any damages (including, without limitation, lost profits, data loss, business interruption, personal injury, or damage to devices or software) arising from the use or inability to use the game. To the fullest extent permitted by law, you agree that no claims for any kind of damages shall be made against Leafy Wave Interactive in connection with your use of the game.

6. TERMINATION

This license will terminate automatically if you violate any part of this Agreement. Upon termination, you must uninstall and delete all copies of the game from your device(s).

In addition, Leafy Wave Interactive reserves the right to terminate this Agreement immediately if you engage in any activity that may cause harm to the integrity of the game or violate any laws or third-party rights.

7. PRIVACY

By downloading and using the game, you agree to our Privacy Policy, which explains what data we collect and how we use it. This policy includes details on how we process your personal data and your rights in relation to that data.

8. TERMS AND CONDITIONS

By downloading and using the game, you agree to our Terms and Conditions, which includes details on how you may use the game, your rights and obligations, and the limitations of liability. Please review our Terms and Conditions at: https://leafywaveinteractive.com/balloonOdysseyTerms.

9. CHANGES TO THE AGREEMENT

Leafy Wave Interactive reserves the right to modify this Agreement at any time. You will be notified of any changes to this Agreement, and your continued use of the game after such changes will constitute your acceptance of the modified Agreement. If you do not agree with the modified terms, you must stop using the game and uninstall it from your device(s).

10. PURCHASE AND REFUND POLICY

By purchasing "Balloon Odyssey," you acknowledge that the purchase grants you a non-transferable, non-exclusive license to use the game on your personal mobile device, subject to the terms of this Agreement.

All purchases are final. Unless required by law, no refunds will be issued for purchases of the game.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.

12. CHANGES TO THIS AGREEMENT

Leafy Wave Interactive reserves the right to update or modify this End User License Agreement (EULA) from time to time, in order to improve the game, fix issues, comply with legal requirements, or enhance security. Any changes will not affect the rights you have already acquired by purchasing the game. It is recommended that you review this Agreement periodically to stay informed about any updates. By continuing to use the game after changes are published, you agree to the updated terms (EULA). If you do not agree with the updated terms (EULA), you may stop using the game and uninstall it from your device.
